These websites are managed by Offporter.com S.r.l. (hereinafter also referred to as “Offporter”) on behalf of Orbico SportStyle S.r.l., licensee of the Dockers trademark for the territories of the European Union, United Kingdom and Switzerland and exclusive reseller of the related products in those markets on behalf of Authentic Brands Group, LLC, the trademark owner. All three companies may therefore process the personal data of Website users and Dockers customers, each for its own purposes and acting as an independent data controller, and each remains directly responsible for the processing activities carried out towards data subjects.

The purpose of this notice is to provide a clear and detailed explanation of how, when and why we collect and use your data, in compliance with the General Data Protection Regulation (GDPR), the Swiss Federal Act on Data Protection (FADP) and the UK Data Protection Act (DPA). It has been drafted to present our personal data protection policy in a simple and transparent manner and to explain how you may effectively exercise your rights.

This information relates exclusively to data processed through this Website and does not concern other websites, platforms or social media pages that may be accessed via links on the Website. In such cases, you should always refer to the privacy information provided on the relevant third-party pages.

1. Who is the Data Controller of my personal data?

The Website is operated by Offporter.com S.r.l. (Tax Code and VAT No. 04081050363), which is responsible for the sale of products to customers and related services (such as payment processing, product delivery, returns management, etc.), as well as for account management and ancillary services (such as customer service and the sending of communications).

In relation to these activities, Offporter acts as the Data Controller of users’ personal data and may be contacted at the following details:

Other parties are also involved in the provision of the Website and related services. These parties may act either as independent Data Controllers or as Data Processors on behalf of the relevant Data Controller, as further specified below (for the list of service providers involved, please refer to Section 5 below).

2. When do you collect my data?

Through the Website, information is collected directly from users:

  • when they submit inquiries through the dedicated sections or contact details;

  • when they request assistance regarding Dockers products and/or services;

3. What data will you process?

    Certain personal data whose transmission is implicit in the use of internet communication protocols are acquired by the IT systems and software procedures that ensure the proper functioning of the Website. These include, but are not limited to, data traffic information, location-related data, weblog data, and other communication data that may be relevant for billing purposes or relating to the resources accessed through your device.

    Although such information is not collected in order to be associated with identified individuals, by its very nature it may allow users to be identified through processing and association with data held by third parties.

    This category of data includes, for example, IP addresses or domain names of the computers used by users connecting to the Website, the unique addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the server’s response, and other parameters relating to the user’s operating system and browser.

    • Legal basis for the processing: OFFPORTER’s legitimate interest in ensuring the proper functioning of the Website and the security of browsing activities, duly balanced against the rights and freedoms of the data subject (Art. 6(1)(f) GDPR).

  2. Request for information through the dedicated sections

    You may contact us through the contact form, by using the contact details provided on the Website, or by using the live chat service available on the Website to request information or assistance, including in relation to specific products available on the Website.

    This will result in the subsequent collection of the data you have provided to us (such as your name, surname, email address, and any information or files included in your communication) and, of course, will allow us to send you responses using the contact details you provided at the time of your request.

    • Purpose of the processing: to provide you with appropriate support in relation to your needs and to respond to your requests.

    • Legal basis for the processing: performance of the service you have requested (Art. 6(1)(b) GDPR).

  3. Registration and access to the Dockers Crew personal account

    You may create a personal account by completing the form available on the dedicated page of the Website, through which you will be able to manage and review a summary of your orders. Users who activate a personal account also benefit from specific advantages compared to “guest” users and may access exclusive promotions and discounts, including periodic offers.

    To create and access your account, you will be required to provide an email address, which will be associated with your account, and to create a confidential password. Once your personal account has been created, information relating to the requested services (such as orders placed, payment methods, delivery addresses, returns, etc.) will be stored. Through your personal account, you may also optionally provide and manage additional data that may be requested (for example, your date of birth, as explained under point (e) below).

    As the service is made available through Shopify Inc., during the initial registration you will be required to accept Shopify’s terms of service and privacy policy. Your information may therefore be collected and used by Shopify as an independent data controller for the purposes determined by it.     You may request deletion of the information provided through your account at any time by contacting the Data Controller at the contact details indicated above. In such case, certain data must nevertheless be retained by OFFPORTER for the period required under applicable law (for example, invoicing data relating to purchases made). Deletion cannot be carried out if there are still pending orders; in such cases, you will be asked to wait until the relevant process has been completed before your information can be deleted.

    Please note that Shopify, acting as an independent data controller, may retain certain of your data for the purposes established in its own Privacy Policy:

    Any deletion requests must therefore also be submitted to Shopify. Likewise, Orbico SportStyle S.r.l., as owner of the Website, may process users’ data for its own purposes. For further information, the Privacy Policy can be requested directly to Orbico at the address privacy-OSS@orbico.com.

    • Purpose of the processing: to provide the service requested by the data subject and to enable access to the features and services reserved for personal account holders, including the ability to make purchases, view purchase history, and save delivery addresses and payment methods for future transactions.

    • Legal basis for the processing: performance of a contract to which the data subject is a party (Art. 6(1)(b) GDPR).

  4. Purchase and shipping of products

    Products available in the virtual catalogue may be purchased through the Website. To access this function and complete the purchase process, you may create a personal account, log in to your existing account, or proceed as a “guest” by providing the data necessary for payment, invoicing, and product delivery.

    Even if you already have a personal account, when purchasing products we may require additional information beyond that provided during account registration (for example, a payment method), or you may choose to add or modify previously saved information, such as specifying a different billing or shipping address.

    If this information has already been saved in your personal account, it will be automatically retrieved upon login, although you will always have the possibility to modify it. If you request deletion of your personal account, the Data Controller will retain data relating to completed purchases for the period required under applicable law, particularly for tax and accounting purposes.

    Even when purchasing as a “guest,” you may receive email communications relating to the service, such as order confirmation, shipping confirmation, possible interruption of the purchase process (e.g., “abandoned cart”), or notifications regarding any issues (for example, payment errors). Furthermore, when you purchase products through the Website, certain data (such as your name, surname, and shipping address) must be communicated to the company responsible for logistics and product delivery.

    The data provided at the time of purchase must also be used and retained by the Data Controller in order to comply with legal obligations imposed by law or other binding provisions. In particular, such data must be retained and used for accounting, tax, and product safety compliance purposes. In this regard, please note that if you have provided a contact address at the time of purchase, such address may be used to send you communications concerning a product you have purchased that has been deemed unsafe, in accordance with Regulation (EU) 2023/988.

    • Purpose of the processing: to enable the purchase of products through our e-commerce platform; to ensure the maintenance of accounting records; to comply with tax obligations; and to fulfill recall, withdrawal and information obligations pursuant to Regulation (EU) 2023/988.

    • Legal basis for the processing: performance of the service you have requested and execution of a contract to which the data subject is a party (Art. 6(1)(b) GDPR); compliance with a legal obligation to which the Data Controller is subject (Art. 6(1)(c) GDPR).

  5. Birthday Gift

    Within your personal account, if you are enrolled in the Dockers Crew, you may also indicate your date of birth. Providing this information is entirely optional and left to the user’s discretion.

    This information will be used exclusively to send you discounts, offers or promotions on the occasion of your birthday.

    • Purpose of the processing: to provide the service requested by the data subject and to enhance their experience with the Website’s services.

    • Legal basis for the processing: your consent (Art. 6(1)(a) GDPR).

  6. Newsletter

    The Dockers newsletter is sent by email to users who expressly request it by completing the dedicated form on the Website with their email address. The service is managed by Offporter and is provided exclusively upon the user’s explicit and unequivocal consent (given by selecting the relevant checkbox on the Website). Providing your data is mandatory solely for the purpose of receiving the newsletter; refusal to provide such data will result in the inability to receive the service, without any further consequences.

    The newsletter service is provided through the Klaviyo Inc. platform. As Klaviyo is headquartered in the United States, if you choose to subscribe to the newsletter service, your data may be transferred outside the European territory for this processing activity. Klaviyo implements various measures to ensure that such data transfers take place securely and in compliance with European data protection requirements (in particular, the GDPR).     In any case, if you no longer wish to receive the newsletter, you may unsubscribe by clicking the unsubscribe link included at the bottom of each email, or by sending a specific request to europe@dockers.orbico.com. The unsubscribe process is partially automated; therefore, you may continue to receive newsletters for a short period after your request, in any event no later than 72 hours from the unsubscribe request, if such communications had already been scheduled prior to its receipt.

    • Purpose of the processing: to send the data subject email communications relating to Dockers products and the services provided by Offporter through the Website, including news and updates on related topics, as well as offers and promotions reserved for subscribers to the service.

    • Legal basis for the processing: the data subject’s consent (Art. 6(1)(a) GDPR).

  7. Customer Service and Live Chat 

    When requesting assistance via email or using the Live Chat service, data are provided voluntarily and directly by the user.     Data of users who use the Live Chat or customer service to request information will be processed solely for the purpose of responding to the requests submitted by the user.

    Please note that the email and chat service is integrated with automated artificial intelligence systems provided by Gorgias through the services of OpenAI OpCo LLC and Anthropic LLMs. These providers operate under a contractually established “zero-data-retention policy,” which prohibits the use of user data for the training of their software or AI models.

    Furthermore, the automated procedure will be carried out in compliance with Recital 71 of the GDPR. Users will always be informed when interacting with AI systems and will always have the possibility to request human intervention and review of their request.

    • Purpose of the processing: to provide you with appropriate support in relation to your needs and to respond to your requests.

    • Legal basis for the processing: performance of a contract or pre-contractual measures at the request of the data subject (Art. 6(1)(b) GDPR).

  8. Product Reviews

    The Website provides a Review service that may be used by registered users who are logged in to review products they have purchased. This functionality is provided through the platform of Yotpo Ltd.; therefore, we refer you to its privacy information regarding the processing of personal data and invite you to read it carefully before using the service: https://www.yotpo.com/privacy-policy/.

    Reviews may only be submitted after a purchase and will be published on the Website, displaying the user’s name, surname and country, based on the information provided by the user.

    The processing is carried out for the following purpose:

    • Purpose of the processing: to collect and publish customer reviews regarding products sold through our e-commerce platform.

    • Legal basis for the processing: performance of the service you have requested and execution of a contract to which the data subject is a party (Art. 6(1)(b) GDPR).

  9. Customer Satisfaction Surveys

    When you make a purchase on our Website, request information, or use the returns service, you may be invited to complete customer satisfaction surveys. Completing the survey is entirely optional, and you may choose to skip it without any consequences.

    The data provided through such surveys will be used by the Data Controller and by the relevant service providers (for example, Gorgias Inc. for customer service, Damian Valley Partners, S.L.U. for product returns services, and/or Yotpo Ltd for review services) exclusively for the purpose of improving their products and services.

    • Purpose of the processing: to analyse customer satisfaction levels and to improve the products and services offered through the Website.

    • Legal basis for the processing: the legitimate interest of Offporter and the other service providers in assessing customer satisfaction levels and improving the products and services offered through the Website (Art. 6(1)(f) GDPR).

  10. Verification of the proper functioning of the Website and services

    The actions performed by users when using the services (for example, the types of requests submitted to customer support) may also be used by Offporter for monitoring purposes and for the continuous improvement of the services provided through the Website, including the correction of any bugs, anomalies and/or errors, as well as the ongoing enhancement of the services themselves.

    • Purpose of the processing: to verify the proper functioning of the services provided through the Platform.

    • Legal basis for the processing: Offporter’s legitimate interest in ensuring the proper functioning of the services provided, duly balanced against the rights and freedoms of the data subject (Art. 6(1)(f) GDPR).

  11. Sending marketing communications based on legitimate interest and soft spam provisions

    In certain cases, we may use the email address provided by the user through the Website (for example, in connection with a personal account, a product purchase, or requests relating to specific products) to send promotional communications without requesting prior consent from the user.

    This processing will be carried out in accordance with Article 6(1)(f) GDPR and Article 130(4) of Legislative Decree No. 196/2003 (as amended).

    In particular, users are informed of this processing activity through this Privacy Policy and are always granted the right to object to such processing easily and free of charge. Each communication sent by the Data Controller includes a reference to this information and instructions on how to opt out of further communications, either by contacting the Data Controller or by clicking the dedicated unsubscribe link provided at the bottom of each message.

    • Purpose of the processing: to inform you about products similar to those you have previously purchased and that may be of interest to you.

    • Legal basis for the processing: the legal provision set out in Article 130(4) of Legislative Decree No. 196/2003, which permits the sending of communications relating to products or services similar to those previously requested (Art. 6(1)(c) and (f) GDPR).

  12. Cookie

    What are cookies? A cookie is a small text file that stores brief information relating to your browsing activity on a specific website and is installed on your device when you access it. Each cookie contains different data (for example, the name of the server from which it originates, a numerical identifier, etc.), may remain on your system for the duration of a session (until the browser is closed) or for longer periods, and may contain a unique identification code.

      These cookies track choices made on the Website and data relating to users’ online browsing behaviour (for example, pages viewed, time spent on a page, etc.) in order to perform statistical analyses, generally in anonymous and aggregated form.

      If users can be tracked and identified through such analyses, these tools may only be used after obtaining the user’s consent.

4. For what additional purposes may your data be used?

Your personal data may also be used for the following purposes:

  1. to comply with legal obligations and requests from public or governmental authorities;

  2. to manage any disputes or litigation and therefore defend OFFPORTER’s rights, whether in or out of court;

  3. to manage contractual and service relationships with Orbico SportStyle S.r.l., licensee of the Dockers trademark and owner of the Website;

  4. to manage contractual relationships with Authentic Brands Group, LLC, owner of the Dockers trademark.

In such cases, the legal bases for the processing will be:

  • for point (a), compliance with a legal obligation;

  • for point (b), the Data Controller’s legitimate interest in protecting its rights, provided that such interest is duly balanced, on a case-by-case basis, against the rights and freedoms of the data subject;

  • for points (c) and (d), the performance of contractual obligations between the parties and their legitimate interest in ensuring the proper functioning of the Website and related sales services, as well as the lawful use of the Dockers trademark.

5. With whom will your data be shared?

In line with the purposes described above, OFFPORTER’s personnel may be authorised to process users’ data in order to provide the requested services, information or support.

Access to personal data will in any case be expressly authorised by the Data Controller, who may, where necessary, appoint the entities engaged for the provision of services and related activities as Data Processors pursuant to Articles 28 and 29 GDPR.

7. Are my data processed outside the EU, the United Kingdom and Switzerland?

The data processed by OFFPORTER are stored on servers located within the European Union and are provided by Shopify International Limited through Google Inc.’s Cloud Platform service (https://datacenters.google/locations/).

However, certain service providers, such as those involved in cookies or newsletter services, are based in non-European countries, particularly the United States. In such cases, personal data may be transferred to servers located in the United States. Whenever this occurs, compliance with the safeguards required under the adequacy decision adopted by the European Commission on 10 July 2023 concerning personal data transferred from the EU to U.S. companies will be verified, including confirmation that the relevant provider adheres to such framework.

Accordingly, all necessary precautions will be taken to ensure the highest level of protection of personal data, by relying on:

  • a) adequacy decisions adopted by the European Commission for third countries;
  • b) appropriate safeguards provided by the recipient pursuant to Article 46 GDPR;
  • c) the adoption of Binding Corporate Rules (BCRs);
  • d) the safeguards provided under the EU-U.S. Data Privacy Framework for participating organisations.

The Dockers trademark is owned by the U.S. company Authentic Brands Group, LLC and licensed to Orbico SportStyle S.r.l. (VAT No. 02710320363). In the event of revocation of such licence and/or in other cases provided for, personal data collected through the Website pursuant to this Privacy Policy may be transferred to Authentic Brands Group, LLC and/or to another entity designated by it, which may also be located outside the European territory.

8. How long will you retain my data?

OFFPORTER will process your personal data for the period reasonably necessary to achieve exclusively the purposes previously described (see the section “What data will you process?”) or for the retention periods required by applicable sector-specific legislation.

For example, data relating to purchases will be retained for the period required under tax and accounting laws and, in principle, for approximately 10 years (the general limitation period for rights pursuant to Article 2946 of the Italian Civil Code).

  • data relating to your Website account will be retained for the duration of the service or until you request deletion;
